Perjury & Contempt of Court
Perjury is a common law offence, there are no statutory provisions from which to elicit powers or guidance on its commission – these have evolved through the common law. Perjury carries severe penalties on conviction – the investigation and prosecution of perjury has its own peculiarities, with a unique set of proofs and definitions. s2c© provides a comprehensive understanding of the offence of perjury, enumerating the requisite proofs, definitions, penalties, powers of arrest and detention – affording the user an overview of the entirety of elements implicit in such offences and those implicit in a subornation of perjury offence, thereby enhancing ones understanding of where, how and by whom these offences may be committed, with examples of their commission and applicable precedents, ensuring a well grounded appreciation of the constituents necessary for the prosecution and investigation of these unique offences.
Like perjury, Contempts of Court are also offences contrary to the Common Law, our module deals with such offences committed in facie curiae or in the face of the Court. In situ breaches behove a knowledge on the part of relevant authorities on how to deal with such offences when deemed as such by a Judge - s2c© outlines powers of arrest, detention, definitions and precedents to ensure a timely, competent intervention and subsequent investigation when such offences are at issue.
Summonses and Charge sheets are often at issue in the Courts – defects, in dates, identifications, Court areas, vehicle numbers, manner of application, service, issue – practically anything concerning the construction or delivery of summonses may feature in any Court of record. s2c© offers a module dedicated to summonses, charges, summary, indictable and hybrid offences, to give the user an expansive insight to relevant matters, defects that may and may not be remedied, modes of application, service and re-issue of summonses, together with sections on jurisdiction of the Courts, notice of alibi's, jurisdictional reversal and precedents - to give the user a practical understanding of the issues that may potentially impact on summonses and charges, ab initio.
